Thank you for booking your holiday with us! Please carefully note the following:
Deposit:
We require a minimum, per person non-refundable deposit (found on your invoice) which is due when you book to secure your reservation. We require the deposit within 5 business days, or your reservation may be cancelled.
Interim Payments:
Interim payments if applicable must be received as indicated on your invoice. Final payment must be received by Scuba Getaway prior to departure as indicated on your invoice or your reservation may be cancelled subject to these terms and conditions. Reservations made within 90 days of departure require full payment at time of booking.
Airfare: Please contact our travel partner at Expedia, Joel at joelsmith@expediacruises.com for information on booking flights.
Credit Card Bookings:
Your authorization to use your credit card number for deposit and/or final payment indicates your compliance with our booking terms and conditions, whether or not you have actually signed the appropriate draft. Verbal authorization of your credit card confirms your reservation.
Pricing:
All prices are quoted in the currency indicated on your invoice unless stated otherwise and are current at time of printing. These prices are subject to change without notice due to change of air flight provider, fluctuations in currency exchange rates, fuel prices, departure taxes, transportation related fees, navigational charges, airport security charges, visa and tourist card charges, etc. However, if the total price increases more than 7 percent (exclusive of increases in retail and GST tax) you have the option to cancel and obtain a full refund. No price increases are permitted after you have paid in full.
Cancellation: Client(s) must provide written notice of cancellation to Scuba Getaway Inc. Reservations are secured once initial deposit payment has been made, with subsequent payments required to be paid in full. All payments are non-refundable.
Refunds will only be offered in the following circumstance: In the event of cancellation, Scuba Getaway may allow the transfer of the reservation to a new and suitable client. Only upon completion of the trip, may any refunds, less administrative fees, be made.
We strongly suggest purchasing cancellation/travel insurance.
WE HIGHLY RECOMMEND YOU PURCHASE CANCELLATION INSURANCE WHICH MAY PROTECT YOU AGAINST THESE CHARGES
Responsibility:
Every effort will be made to operate all travel services as advertised, however Scuba Getaway reserves the right at its discretion to modify any arrangements, accommodations, flights and services that cannot be supplied due to delays, cancellations, weather conditions or any other causes beyond our control. In all cases Scuba Getaway will endeavour to provide comparable services, arrangements, and accommodation for those cancelled or delayed, however Scuba Getaway acts as an agent only for other independent suppliers and cannot be held responsible for any losses resulting from their acts or omissions.
Changes in Accommodation / Facilities:
Every effort has been made to ensure that the facilities described will be available during your vacation. However, Scuba Getaway does not control the management of liveaboards, cruise lines, hotels and resorts and it cannot be responsible if some of the facilities described cease to be available or are not operating during your trip.
Please note that living standards, practices and the provision of utilities, services and accommodation at your travel destination may differ from those found in Canada or the USA.
Flights and Carriers:
All flight times, flight itineraries and carriers are subject to change with or without prior notice. We recommend that you contact the airline within 24 hours of departure to reconfirm your departure and check in time. Scuba Getaway cannot be held responsible if you miss your flight or are denied boarding. For up to date information on Airport Transport Security Measures please contact Transport Canada at www.tc.gc.ca and the Canada Airport Transport Security Agency at www.catsa.ca or 1-888-294-2202.
Connecting Flights:
Passengers with connecting flights are advised to allow ample time (minimum 3 hours/recommended overnight) between flights. Scuba Getaway cannot be held responsible if you miss your flight or are denied boarding.
Cruise Connections:
Scuba Getaway cannot be held responsible for expenses incurred by passengers who have missed their cruise connection.
Flight Delays:
Flights delays can occur through Acts of God, mechanical breakdowns, employee strikes and by direction of government. Scuba Getaway cannot be held responsible for any consequences arising from such delays.
Delays at Destination:
If any delays are caused by Acts of God, such as weather conditions, mechanical breakdowns, employee strikes, direction of government or any other similar acts beyond the control of Scuba Getaway or its suppliers, then costs associated with such a delay must be paid for by the traveller.
Medical Information: Participation in scuba diving itineraries requires the participant to be of generally good health. Travellers may be required to complete a medical history. Travellers with medical problems or dietary restrictions should make them known, in writing, to the reservation office with final payment. The dive operator’s staff will reserve the right to deny a traveller’s participation in any activities, at their discretion. Also, certain vaccinations and precautions may be required for some destinations. We recommend that you consult your family physician or visit your local travel clinic. You may also visit www.istm.org for additional information.
Documentation:
It is the traveller’s responsibility to ensure they are in possession of the correct documentation required for the journey to their destination and the return to their home country. Always check your passport, visa and tourist card requirements. For a current guide of documentation requirements please visit www.voyage.gc.ca (for Canadian residents) or www.travel.state.gov (for USA residents). Please note that entry into another country may be refused even if your travel documentation is complete.
SCUBA GETAWAY CANNOT ASSUME RESPONSIBILTY FOR PASSENGERS NOT HAVING CORRECT DOCUMENTATION
You must hold a valid passport. Your passport must be valid 6 months beyond your intended return.
You must provide full address and phone number for destination at airport check-ins.
No price increases are permitted once paid in full. If the total price of the travel services is increased by more than 7% (except increases resulting from an increase in retail sales tax or federal goods and services tax), you have the right to cancel the contract and obtain a full refund.
We recommend you reconfirm your flight times directly on the airline’s website 24-30 hours prior to your flight. Passengers who have special needs or considerations are advised to add extra time to check-in.
Please be aware of the appropriate check-in times, baggage fees and restrictions for your itinerary. Please note that many airlines charge additional fees for checked baggage. This fee is not included in your total trip cost, refer to your specific airline for their weight allowance and baggage charges.
Refer to your itinerary for specific flight times, refund and change penalties once airline tickets have been paid in full and issued.
Ensure that you have adequate time to complete check-in, security, immigration and/or customs formalities. Screening officers may ask that travelers present electronics for screening and request that some devices, including cell phones, be powered up. Powerless or broken devices will not be permitted on the aircraft. Please ensure that the electronic devices you bring with you are fully powered before you arrive at the airport. Travelers and their carry-on baggage may also undergo additional screening.
Check-in counters and the time required for pre-boarding procedures vary from airline to airline, refer to your specific airline requirements.
Failure to check-in on time could result in your seat being released. You could be denied boarding and incur additional costs to travel, at your own expense.
Gate assignments, departure and arrival times are subject to change. Check directly with the airline for up-to-date information.
Seat Selection is subject to availability, at airport check-in. Arranging seat selection in advance is subject to airline rules and possible fees.
A valid passport is mandatory for all destination outside of Canada. Some countries require that your passport be valid for at least 6 months beyond intended return date.
Travelling with a damaged passport may cause significant delays at check-in and security. You may be denied boarding or entry. Your passport should be in its original condition. Refer to http://www.ppt.gc.ca/ and https://www.iatatravelcentre.com/ for more information. Many countries require a visa for entry. Confirm and carry the correct and valid documentation for your itinerary. You are also responsible for ensuring that all necessary vaccinations are obtained prior to departure, as you may be required to present proof of vaccination by the country you are entering.
Refer to the Canadian Foreign Affairs website for the most updated entry/exit requirements for countries worldwide, as well as official government travel warnings for Canadian Passport holders travelling abroad at www.travel.gc.ca. Entry to another country maybe refused even if required information and travel documents are complete. Living standards and practices at the destination and the standards and conditions there with respect to the provision of utilities, services and accommodation may differ from those found in Canada.
Diver Certification and Insurance:
Divers are required to provide proof of valid diver certification required for level of trip outlines in reservation. Dive insurance is mandatory for all divers. Scuba Getaway Inc. recommends Dive Assure: https://diveassure.com
Baggage:
It is recommended that you confirm your baggage allowance with respective carriers. If your carriage is by more than one carrier, different conditions, baggage allowances, regulations and any applicable tariffs may apply for each carrier. These conditions may be obtained from the issuing carrier. Scuba Getaway has no control. Scuba Getaway cannot be held responsible for the loss or damage of baggage. Travellers are urged to insure their baggage before leaving home.
Unused Services:
No refund is allowed for any unused services.
General Conditions of Carriage and Tariffs:
Voluntary changes to your itinerary may require the payment of additional fees and fare upgrades. Change Fees and Cancellation Fees may apply per direction, per passenger, plus applicable taxes and any additional fare difference. Advance seat selection is subject to availability and the rules and fees of individual carriers.
Notice:
Carriage and other service provided by the carrier are subject to conditions of contract, which are hereby incorporated by reference. These conditions may be obtained from the issuing carrier. If your carriage is by more than one carrier, different conditions, regulations, and any applicable tariffs may apply for each carrier.
Legal Relationships and Liabilities:
Scuba Getaway makes arrangements with liveaboards, cruise lines, hotels, resorts and other independent contractors and suppliers to provide you with the travel services you purchase. Although Scuba Getaway takes great care in selecting these suppliers, Scuba Getaway acts as an agent and therefore cannot be responsible for any claims, losses, damages, costs, or expenses of any nature arising from any injury, accident, death, loss of or damage to or delay in connection with baggage or other property; delay, inconvenience, upset, stress, loss of employment or loss of vacation time resulting from:
1) The act of fault of omission of any part other than Scuba Getaway of its employees. 2) Acts of God, war, acts of terrorism, acts of foreign enemies, rebellion, mechanical breakdown, Government action, weather, sickness, theft, labour disputes or any other factor or condition beyond our control. 3) Customers failure to obtain required documentation necessary for the journey and return. 4) Being
denied access to aircraft due to contravening the airline’s conditions of carriage. 5) Being held by Government direction. 6) The traveller missing flight connections. 7) Cancellation or change for any reason in the travel services offered 8) The traveller failing to follow directions of Scuba Getaway or its representatives.
No representatives of Scuba Getaway or its suppliers have the authority to modify or waive any provision of this agreement.
Disclosure Requirement Regarding Out of Province Suppliers:
In accordance with the Travel Industry Council of Ontario’s regulations, Section 36(a) of Ontario Regulation 26/5, we are required to advise customers, that services purchased from and out of province tour operator or end supplier, other than an airline and/or cruise line, are not covered by the Ontario Travel Industry Compensation Fund in the event of the bankruptcy or insolvency of that service provider. The exemption is not a new change in the act, but it is our responsibility to notify you of this requirement.
